BARNES Agencies in the Mont Blanc region (hereinafter referred to as BARNES MONT-BLANC) attach great importance to protecting and respecting your privacy and your personal data (hereinafter referred to as "Personal Data" or "Personal Information").

In any event, we undertake to comply with the following two (2) essential principles:

      5.1.7 For processing: Management of initial contact before applying for a tenancy

      Information relating to the service: Characteristics of the accommodation sought, Deadline for completion (maximum), Appointment date, Reference (tenant/owner), Current rent (if applicable).

      5.1.8 For processing: Management of property transactions (sale/purchase mandates) 

      Information required for the administration of property, co-ownership associations and property transactions: Internal processing code enabling identification, Rental or home ownership conditions, Details of goods and services provided, Information concerning the property concerned, Housing identification number, Housing status (owner or tenant). 

      Documents with legal value: accounting and financial statements, copy of property tax, minutes of General Meetings 

      Financial information: Commission, price of the property concerned

      5.1.9 For processing: Management of residential property sales 

      Information required for property management, joint ownership and property transactions: Information about the property 

      Documents with legal value: certificates, accounting and financial statements, sales agreements, KBis excerpts, minutes of general meetings, etc. 

      Financial information: assessment of income, bank/insurance company statements, tax returns, tax share, proof of salary, assets (land, property, accounts and investments, etc.), source of funds from which the purchase was made, economic and financial situation, solvency, etc.

      5.2 Recipients of your data 

      Within the limits of their respective responsibilities and for the purposes set out in Article 4, the main people who are likely to have access to your data are as follows:

      Other organisations that may have access to your data are : 

      • Where appropriate, the courts concerned, mediators, chartered accountants, statutory auditors, lawyers, bailiffs, debt collection agencies, etc; 
      • Third parties likely to place cookies on your terminals (computers, tablets, mobile phones, etc.) when you give your consent (for more details, consult our Cookie Policy); 

      Your personal data will not be passed on, exchanged, sold or rented without your express prior consent in accordance with the applicable legal and regulatory provisions.



      5.3 Transfer of data outside the European Union 

      In some cases, your personal information is stored on servers located in the EEA. 

      You may request access to the documents ensuring the presence of appropriate safeguards by sending a request to our Data Protection Officer by e-mail to dpo.montblanc@barnes-international.com.



      5.4 Data retention period 

      We keep your data only for as long as is necessary for the purposes for which it was collected, as described in article 4 of this Charter, and, if necessary, for longer as required by law. 

      You can check the retention periods applied to the processing operations that concern you by contacting our Data Protection Officer by e-mail at dpo.montblanc@barnes-international.com. 

      An overview of the retention periods applied is given below: 

      • Commercial communication: 2 years after the last contact. 
      • RGPD compliance: For the duration of RGPD compliance 
      • Management of actions against money laundering (TRACFIN) :
        - Normal vigilance: 5 years after the end of the mandate/contract
        - Enhanced vigilance: until receipt of the return from the government department, plus a period imposed by TRACFIN. 
      • Management of individual building access systems: 1 month 
      • Communication management: 2 years after the last contact. 
      • Management of the quality approach: 6 months, unless there is a need for personalised individual training. after aggregation of the data using statistical methods. 
      • Management of initial contact before applying to rent:12 monthsIf the application is submitted: the necessary information can be included in the application. 
      • Management of property transactions (sale/purchase mandates):
        - on an active basis: until the end of the calendar year from the end of the mandate OR from the last contact (if the mandate has not been signed) and data recovery for "Prospecting for former customers" (see Customer Prospecting activity).
        - in archives: 8 years after the end of the mandate
      • Management of residential property sales:
        - on an active basis: until the end of the calendar year from the end of the mandate and data recovery for "Prospecting former customers" (Cf. Customer prospecting activity)
        - in archives: 8 years after the end of the mandate 
      • Property management :
        - Active base: 3 years after mandate
        - Internal archives: 5 years after the term of office. 
      • Managing applicants to rent a property:
        - Active basis: up to year N+1 from the response date
        - Internal archiving :
           - (Unsuccessful candidates) until year N+6 from the date of the response.
        .  - (Tenant) transfer of elements required in the "Rental management" activity 
      • Customer file management :
        - FOR A RENTAL: 3 years from the date of departure of the tenant
        - FOR A SALE: 8 years 
      • Seasonal rental :
        - The identity of the tenant, rent receipts, rental contracts, inventories of fixtures: in the active database - during the rental period; in the internal archives: 3 years after the rental period.
        - All correspondence relating to rent reviews: in the active database - during the rental period; in the internal archives: 1 year after the rental period.
        - Information on the income assessment of the tenant and guarantors: until the 4th month following the end of the tenancy.
        - Furniture inventories for furnished lets: on an active basis - until the security deposit is returned
        - In the event of litigation: any relevant information may be retained during the litigation period (see Litigation management).
      • Prospecting: 8 years after the last service provided to the customer. 
      • Recruitment :
        - unsuccessful applications: up to 2 years from the last contact (once the person has given their consent)
        - successful candidates: until staff are integrated 



      5.5 Individual rights

      In accordance with the Data Protection Act and the RGPD, you have the following rights: 

      5.5.1 Right to information on the processing of Personal Data 

      BARNES MONT-BLANC undertakes to use its best efforts to provide concise, transparent and accessible information on the conditions of processing of your Personal Data at the time of collection or within a reasonable period of time after collection.


      5.5.2 Right of access to Personal Data 

      You may access your Personal Data processed by BARNES MONT-BLANC and have the right to receive a copy in electronic form (for any additional copy, BARNES MONT-BLANC shall be entitled to charge a fee based on the administrative costs incurred). 


      5.5.3 Right to erasure ("right to be forgotten") and rectification of Personal Data 

      You have the right to request the deletion and/or rectification of your Personal Data if it is erroneous or obsolete. It is specified that BARNES MONT-BLANC may retain certain Personal Data when required to do so by law or in the event of a legitimate reason. It is possible that if your Personal Data is deleted following your request and before the expiry of the valid retention period, this may prevent us from providing you with certain services that you expect from us. 


      5.5.4 Right to object 

      You may object at any time on legitimate grounds to the re-use of your Personal Data for processing other than that notified, except in the event of the fulfilment by BARNES MONT-BLANC of one of its legal obligations. We would like to emphasise this right which concerns you more specifically as a "professional", when you no longer wish to receive canvassing from us.


      5.5.5 Right to limit the processing of Personal Data 

      You have the right to request that the processing of your Personal Data be limited to that which is necessary. This right is applicable only : 

      • if you dispute the accuracy of your Personal Data; 
      • if you can establish that the processing of your Personal Data is unlawful and require the restriction of its use rather than its erasure; 
      • if BARNES MONT-BLANC no longer needs your Personal Information but it is still required for the establishment, exercise or defence of legal claims; 
      • if you object to processing based on a legitimate interest pursued by us as Data Controller, having confirmed that the legitimate interests pursued by us prevail over yours.

      BARNES MONT-BLANC has set up a cookie manager via the Cookies Policy in order to inform you more specifically about their use.       The BARNES MONT-BLANC website and its services are not intended for minors. BARNES MONT-BLANC does not voluntarily collect personal data from minors under the age of 15.
